Participation in this online-only Promotion requires internet access, and a valid email address and an Eligible Participant must set their account on the applicable Entry Platform (found in Rule 3) preference to “public” in order to receive any winner notification from the Sponsor. By submitting an entry, Eligible Participant agrees to comply with all requirements of the Official Rules, which is a contract between the Sponsor and each Eligible Participant. Any costs and expenses related to internet access, data usage or connectivity required to participate in the Promotion are the sole responsibility of the Eligible Participant, in accordance with the terms of the relevant service provider.
These Official Rules are available free of charge at https://pokemongo.com/contest-rules/go-memories-sweepstakes for the entire duration of the Promotion.
This Promotion, organized by Niantic, Inc., for the mobile video game Pokémon GO, is only intended for viewing and participation in the fifty (50) United States and Washington D.C. (together the “United States”); Canada; Mexico; the United Kingdom; metropolitan France; Spain; Denmark; the Netherlands; Germany; Japan; Taiwan; and South Korea (individually each a “Participating Country” and collectively the “Participating Countries”). Please do not participate if you are not a legal resident of, and not located in, a Participating Country and at least the age of majority in your jurisdiction of residence at time of participation. Participation is void outside the Participating Countries.
Overview: The Promotion will be available for entry on Instagram, TikTok, X and Reddit (each social media platform called an “Entry Platform”) during the Promotion Period where available. Niantic, Inc. (the “Sponsor”) invites Eligible Participants (see Rule 2) in Participating Countries to enter for a chance to win one of fourteen prizes, each a trip for winner and one guest to Pokémon GO Fest in Tokyo, Chicago or Copenhagen (refer to Rule 6 for Prize Details). This promotion is administered for the Sponsor by The Marketing Store Worldwide (“Administrator”) and its affiliates (together the “Promotion Entities”).
1. Promotion Period: Starts March 10, 2026, at 12:00:00 a.m. Pacific Daylight Saving Time (“PDT”) and ends April 30, 2026, at 11:59:59 p.m. PDT (the “Promotion Period”). The Promotion Period includes three separate prize draws carried out on three different dates during the Promotion Period (each a “Prize Draw”) as follows: Entry for the Tokyo Event (May 29, 2026 to June 1, 2026) ends March 22, 2026 at 11:59:59 p.m. PDT (“Prize Draw #1”); Entry for the Chicago Event (June 5, 2026 to June 7, 2026) ends April 5, 2026 at 11:59:59 p.m. PDT (“Prize Draw #2”); and entry for the Copenhagen Event (June 12, 2026 to June 14, 2026) ends April 30, 2026, at 11:59:59 p.m. PDT (“Prize Draw #3”). Entry into each Prize Draw starts March 10, 2026, at 12:00:00 a.m. PDT.
2. Eligibility: To be eligible to participate in this Promotion, you must be a legal resident of one of the Participating Countries, have reached at least the age of majority in your jurisdiction, have internet access and a valid email address at the time of entry into the Promotion and at the time you are awarded any Grand Prize (each an “Eligible Participant”). Residents of Canada, Denmark, and Mexico who are a potential winner of a prize must correctly answer a skill-testing question (“STQ”) without any electronic, mechanical or other assistance in order to receive a prize (refer to Rule 6). Persons in any of the following categories are NOT eligible to participate or win a Grand Prize: (a) any person who, at any time on or after January 1, 2026, was or is a director, officer, agent, representative, or employee of the Promotion Entities or either of its parent, affiliates, subsidiaries, or service agencies, who are directly involved in the planning or execution of the Promotion; (b) any other individuals engaged in the development, production or distribution of materials for the Promotion or engaged in the administration or execution of this Promotion; (c) persons who are or purport to be immediate family members (defined for purposes of this Promotion as biological or step-parent, sibling, child, dependent, domestic partner or spouse of any of the foregoing) of any person in any of the preceding categories, regardless of where they live, or who reside in the same household as any person in any of the preceding categories; and (d) persons who Sponsor is prohibited from allowing to participate in the Promotion under applicable law. The Promotion is subject to all applicable federal, state, provincial/territorial, county, and local laws and regulations. The Promotion is void outside of the Participating Countries.
3. How To Enter: Eligible Participants can enter the Promotion for a chance to win a Grand Prize by posting on one or more Entry Platforms in accordance with these Official Rules (“Entry”). There is a limit of one Entry per Eligible Participant per Entry Platform. For clarity, an Eligible Participant may enter on each Entry Platform for a total of up to four entries per Eligible Participant during the Entry Period. There is no purchase required to participate at any of the Entry Platforms. Note: This Promotion is in no way sponsored, endorsed, administered by, or associated with Instagram, TikTok, X, or Reddit. By participating, participants agree to release and hold harmless each of these platforms from any and all liability arising from or related to this Promotion.
A. Post/Tweet/Quote Retweet/Reel on Instagram, TikTok or X:
Share on select social media in a way that complies with Entry Content Restrictions (refer to Rule 4), complying with all of the following requirements:
1) To be eligible, your social media account used to enter must be set to “public” (i.e., not a “Private Account”) at the time of entry and must remain public and viewable by Sponsor and Administrator through winner selection and verification at least until May 15, 2026. Entries from accounts that are private, restricted, or otherwise not visible to Sponsor at the time of review will be deemed ineligible and not received. You are solely responsible for adjusting your account settings and for confirming that your post/story is visible to Sponsor.
2) Depending on which Entry Platform you’re posting on, you must follow Pokémon GO and tag the Pokémon GO handle for your Entry post:

3) Include two hashtags in your post/tweet/quote retweet/reel.
i) All entries must include the hashtag: #GOMemories.
ii) All entries also must include a hashtag in one of the following languages matching the language you are using to create your story. Use of any other language will not be permitted for entry. The required hashtags must be clearly visible and not hidden among numerous other hashtags. If included in a list of hashtags, they must appear at the beginning of that list and must be directly visible without the need to click “more” or otherwise expand the post description.

4) Share (text, image or video) a relevant story about playing Pokémon GO. For example: a favorite memory of playing Pokémon GO; the coolest place you’ve discovered while playing Pokémon GO; a photo of you at a Pokémon GO event or playing out in your community with friends; something inspired by your favorite Pokémon (outfit, cupcake, etc.); a Pokémon in your collection that’s meaningful to you; tell who your First Partner Pokémon is, etc. The social post you share will not be judged. On TikTok, the applicable post types are Video Posts or Stitched Video Posts; on X, the applicable post types are tweets and Quote Retweets; on Instagram, the applicable post types are In-Feed Posts and Reels.
5) Maintain your post live on your selected Entry Platform account at least until May 15, 2026.
B. Respond to official thread on Reddit:
1) Reply to one of the official campaign posts on the subreddit r/TheSilphRoad to enter: https://www.reddit.com/r/TheSilphRoad/
2) Eligible Participant is not required to tag any handles.
3) Answer the Sponsor’s question found in the official campaign post.
Your Entry (on an Entry Platform) must meet the Entry Content Restrictions set out in Rule 4 to be eligible.
4. Entry Content Restrictions: By submitting an Entry on an Entry Platform, each Eligible Participant agrees that their Entry conforms to the applicable Entry Platform guidelines and to the content restrictions as defined below (collectively, the “Content Restrictions”). Sponsor and/or the Administrator, in their sole discretion, may remove an Entry and/or disqualify an Eligible Participant from the Promotion if they believe, in their sole discretion, that the Entry fails to conform to the Content Restrictions or any of the applicable Entry Platforms’ terms of use, terms of service or community guidelines, or violates any provision of these Official Rules in any way.
A. Entry Content Restrictions: Each Entry must comply with the following Content Restrictions:
(i) An Entry cannot be sexually explicit or suggestive, profane or pornographic, or contain nudity.
(ii) An Entry cannot be derogatory or promote bigotry, racism, violence, hatred or harm against any group or individual, or promote any form of discrimination whatsoever (including, but not limited to, discrimination based on race, gender, religion, nationality, disability, sexual orientation or age).
(iii) An Entry cannot promote or feature alcohol, drugs (illegal or otherwise), tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any political agenda or message.
(iv) An Entry cannot be inappropriate, indecent, obscene, offensive, hateful, tortuous, defamatory, slanderous or libelous, endorse any form of hate or hate group, or depict cruelty to persons or animals, or content which might be reasonably expected to shock, insult or offend the community, breach community standards of decency.
(v) An Entry cannot defame, misrepresent, reflect unfavorably upon the name or reputation of Sponsor, its products, brands, services, employees, crew or customers, or other people (living or deceased), products or companies, or contain disparaging remarks about Sponsor or its products, brands, services, employees, crew or customers, or other people (living or deceased), products or companies.
(vi) An Entry cannot feature or otherwise mention competitors of Sponsor.
(vii) An Entry cannot use trademarks, logos, trade dress, or any other intellectual property rights owned by others (other than Sponsor) or advertise or promote any brand or product of any kind (other than Sponsor’s). To the extent that the content includes or incorporates any trademarks, copyrights, likenesses, references, materials or other intellectual property belonging to third parties (collectively, “Third Party Materials”), Eligible Participant shall be solely responsible and liable for his/her use of the Third Party Materials and Sponsor makes no representations or warranties regarding, and shall have no obligations relating to, the Third Party Materials.
(viii) An Entry cannot contain any personal information, such as license plate numbers, personal names, e-mail addresses or street addresses.
(ix) An Entry cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate.
(x) An Entry cannot depict, and cannot itself, be in violation of any applicable law, regulation, guidelines, policies or Entry Platform terms of use.
(xi) An Entry cannot contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement.
(xii) An Entry cannot contain any reference to, or likeness of, any identifiable individuals, including a celebrity, athlete, politician or other well-known individual, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their province/territory of residence.
Entries and content on an Eligible Participant’s Instagram/X/TikTok or Reddit account represent the views and opinions of the individual Eligible Participant and do not necessarily reflect the views of Sponsor in any manner. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to Eligible Participants.
B. Entry Conditions. By entering, Eligible Participants must:
(i) acknowledge and represent that they are in full compliance with these Official Rules including all eligibility requirements and,
(ii) agree to be bound by these Official Rules and the decisions of the Sponsor and/or Administrator, made in their sole discretion, which shall be final and binding in all respects.
Eligible Participants who have not complied with these Official Rules are subject to disqualification and all associated entries will be void. Sponsor reserves the right to disqualify any Eligible Participant's registration in the Promotion (and void all associated entries) or entitlement to a Grand Prize if, in the sole discretion of the Sponsor, it determines or suspects that the Eligible Participant has attempted to undermine the legitimate operation of the Promotion by tampering, cheating, hacking, deception, or other fraudulent, deceptive or unfair playing practices (including any entries generated by script, macro, robotic, programmed, or any other automated means or any other means which subvert the entry process).
C. Entry Limitations. Multiple Eligible Participants are not permitted to share the same email address or account. Any attempt by any Eligible Participant to use multiple/different email addresses, identities, registrations and logins, accounts, or any other methods in an attempt to defraud the entry process or gain additional entries will void that Eligible Participant's entries and Eligible Participant may be disqualified. Use of any automated system to participate, as determined by Sponsor in Sponsor’s sole discretion, is prohibited and will result in disqualification.
In the event of a dispute regarding the identity of an Eligible Participant, the Entry will be deemed to have been made by the authorized account holder of the account for the applicable Entry Platform(s). Authorized account holder is defined as the natural person who is assigned to the account associated with the Entry Platform(s) used to participate in the Promotion. Each Eligible Participant may be required to show proof of being an authorized account holder.
Entries submitted by script, macro or other automated or mechanical means, entries by any means which subvert the entry process, and entries that are illegible or made in any fashion other than as specified herein, as determined by Sponsor in Sponsor’s sole discretion, are void. To the extent permitted by applicable law, all Entries become property of the Sponsor and will not be returned.
5. Random Prize Draws: The three Grand Prize Draws will each be conducted by the Administrator. The Administrator will randomly draw the number of entries corresponding to the applicable number of Grand Prizes for each Prize Draw (i.e. four entries for the Tokyo Event, five entries for the Chicago Event, and five entries for the Copenhagen Event) by means of computer program that utilizes a proprietary randomization software (as described below) from among all eligible entries received across all Participating Countries by the deadline for each draw (each a “Potential Prize Winner”). Potential Prize Winners that complete the Prize Claim Process in accordance with the requirements set out in Rule 7 (below) shall be a “Grand Prize Winner” and will be awarded the Grand Prize for the applicable Prize Draw they have entered. The Administrator reserves the right to select 100 alternate Potential Prize Winners as may be required for each Grand Prize in the event that a Potential Prize Winner fails to comply with the requirements set out in Rule 7.
If an entry in Prize Draw #1 is not selected, it will remain eligible and be included in Prize Draw #2 and if still not selected, it will remain eligible and be included in Prize Draw #3. LIMIT: One prize per person.
The odds of winning a Grand Prize depend on the total number of eligible entries received for each Prize Draw from all Participating Countries. Potential Grand Prize Winners will be subject to verification of eligibility and compliance with these Official Rules.
Skill-Testing Question: Each Canadian, Danish, or Mexican Eligible Participant selected as a Potential Prize Winner must correctly answer a skill-testing question (“STQ”), without electronic, mechanical or other assistance of any kind. The STQ will be provided in the Prize Claim Documents (See Rule 7(B)) and must be correctly answered and submitted in a timely manner in order for the Eligible Participant to be a Potential Prize Winner.
Grand Prize winners are individually and collectively referred to as “Grand Prize Winners.” Potential Grand Prize winners are “Potential Prize Winners.” Official clock is determined by Administrator. Entrants are responsible for determining the date and times applicable to their respective jurisdictions.
6. PROMOTION PRIZES: The following fourteen Prizes will be awarded to the Grand Prize Winners in accordance with these Official Rules:
Four Tokyo Event Grand Prizes: A travel package for the winner and one guest to attend Pokémon GO Festival in Tokyo, Japan, at Bay Area, currently scheduled for Friday, May 29, 2026 through Monday, June 1, 2026. The approximate retail value (“ARV”) is up to USD $9,000 (€7,635; DKK57,000; ₩13,000,000; ¥1,393,000; CAD$12,300; NT$283,800).
Five Chicago Event Grand Prizes: A travel package for the winner and one guest to attend Pokémon GO Festival in Chicago, Illinois, U.S., currently scheduled for Friday, June 5, 2026 through Sunday, June 7, 2026. ARV: Up to USD$5,000 (€4,240; DKK31,700; ₩7,247,000; ¥774,000; CAD$6,850; NT$157,700).
Five Denmark Event Grand Prizes: A travel package for the winner and one guest to attend Pokémon GO Festival in Copenhagen, Denmark, at Faelledparken, currently scheduled for Friday, June 12, 2026 through Sunday, June 14, 2026. ARV: Up to USD$8,000 (€6,787; DKK50,700; ₩11,568,000; ¥1,238,000; CAD$10,950; NT$252,000).
Each Grand Prize Includes: Round trip economy class air transportation for winner and one guest from a major commercial airport near winner’s residence to the applicable event city; up to four consecutive nights of standard hotel accommodations (one room, double occupancy); two event admission tickets (one for the winner and one for the guest) valid for the applicable festival dates as determined by the Sponsor; and a meal and ground transportation per diem for both travelers for up to five days of travel, calculated at USD $250 total (or local equivalent) per day for the winner and the guest combined. Alcoholic beverages are not included in the Grand Prize. The actual retail value of each prize varies based on departure city, routing, dates of travel, number of days utilized, flight and hotel class and availability, currency and exchange rates, and seasonal rates. The Grand Prize Winner will not receive the difference between the actual value and the ARV in cash or any other form. The ARV stated in local currency is based on exchange rates (relative to USD) as of February 18, 2026. Exchange rates fluctuate. The USD ARV is the maximum prize value. The ARV of each Grand Prize includes both the travel prize components and cash component ("Tax Assistance Payment"), which is intended to assist the Grand Prize Winner with the payment of any income taxes or other applicable taxes that may be incurred as a result of accepting a Grand Prize. Grand Prize Winner acknowledges and agrees that the Tax Assistance Payment is provided solely as a convenience to assist with potential tax obligations and is not intended to, nor does Sponsor represent or warrant that it will fully cover any or all taxes owed by the Grand Prize Winner in connection with a Grand Prize. The actual tax liability incurred by the Grand Prize Winner will depend on the Grand Prize Winner's individual tax situation, including but not limited to the Grand Prize Winner's income, applicable tax bracket, filing status, and the tax laws of the Grand Prize Winner's country, state, province, or other jurisdiction of residence, and any other applicable taxing authority. The Grand Prize Winner is solely responsible for determining his or her actual tax liability and for the payment of all taxes due in connection with the Grand Prize. Winner is strongly encouraged to consult with an independent tax advisor regarding the tax implications of accepting the Grand Prize. Sponsor will report the full ARV of the Grand Prize (including the Tax Assistance Payment) to applicable tax authorities as required by law, which may include, for U.S. residents, the Internal Revenue Service and applicable state tax authorities, and for non-U.S. residents, the relevant taxing authorities in the Grand Prize Winner's country of residence. Grand Prize Winner will be required to provide Sponsor with appropriate tax documentation as requested prior to receipt of the Prize, which may include a completed IRS Form W-9 for U.S. residents or other applicable tax forms for non-U.S. residents. Sponsor reserves the right to withhold any applicable taxes from the Prize, including the Tax Assistance Payment, as required by law. Except for any withholding required by applicable law, Grand Prize Winner is solely responsible for all applicable taxes, including but not limited to national, federal, state, provincial, and local taxes, and any other costs and expenses associated with acceptance and use of the Grand Prize not specified herein as being provided. By accepting the Grand Prize, Grand Prize Winner agrees to hold Sponsor and the Promotion Entities harmless from any and all claims, damages, or liability arising from Grand Prize Winner's tax obligations related to the Grand Prize. Travel must occur on the dates specified for the event unless the Sponsor, in its sole discretion, permits alternative dates. The Sponsor or its designated travel agent will arrange and book the prize travel and lodging. The Grand Prize Winner and guest must travel together on the same itinerary, including the same flights and hotel stay. The Sponsor reserves the right to determine travel routing and carrier and may include one or more layovers. The Sponsor will determine the major commercial airport near the Grand Prize Winner’s residence. If the Grand Prize Winner resides within a reasonable driving distance of the applicable event city, the Sponsor may substitute ground transportation or provide a travel stipend in lieu of air travel, in each case in its sole discretion, and no additional compensation will be provided. The Grand Prize Winner must respond timely to communications from the Sponsor or its agent and provide all necessary traveler information to facilitate booking. Failure to timely provide required information or to accept travel arrangements as booked may result in forfeiture of the prize in the Sponsor’s sole discretion.
Note: If the guest is under the age of majority in his or her jurisdiction of residence, the Grand Prize Winner must be the parent or legal guardian of that guest.
Total ARV for all prizes combined (USD $101,000) may vary depending on final allocations. Grand Prize Winner and guest must travel on the same itinerary commensurate with the Festival dates. Grand Prize Winners will be solely responsible for ensuring that they and any person traveling with them are available to travel and hold valid passports, and any necessary visas and travel documents (e.g., valid photo identification) for the travel dates specified. If Grand Prize Winner is unable to travel for any reason, the Prize will be forfeited and awarded to an alternate winner, time allowing.
Prizes are not transferable and must be accepted as awarded, with no cash or other substitution, except that Sponsor reserves the right to substitute any element of the prize with an item or package of equal or greater retail value if any advertised element becomes unavailable for any reason.
Except as specifically provided for in these Official Rules, the prize excludes meals, gratuities, incidentals, resort fees, baggage fees, seat selection fees, parking, in-room charges, upgrades, travel insurance, preventative or emergency medical expenses, personal expenses, and any other costs not expressly listed as included, all of which are the sole responsibility of Grand Prize Winner. For Grand Prize Winners residing in France only: The preceding provision is not applicable.
Any federal, state, provincial/territorial, county and local taxes, including the possible gambling tax owed on a prize, are each Grand Prize Winner’s responsibility, regardless of whether a prize is used in whole or in part. All prize details are in the Sponsor's sole discretion. Grand Prize Winners may be required to complete and return prize claim and/or tax forms such as an IRS Form W-9 or W-8BEN (“Forms”) as required by their local jurisdiction within the deadline stated in the winner notification document(s) (found in Rule 7.B.). Prize Winners are advised to seek independent tax counsel regarding the implications of accepting a Grand Prize. The Prize Winner is responsible for reporting and paying any applicable gambling tax.
7. Grand Prize Claim Process:
A. Direct Message Notification. Potential Prize Winners will first be contacted via direct message through the applicable Entry Platform they used to enter. Any such Potential Prize Winner will need to respond to direct message with the requested information in 24-48 hours (depending on the Entry Platform rules). If a Potential Prize Winner does not have their settings on “Public” and does not respond with their requested contact information in the time provided, that Potential Prize Winner will be disqualified and an alternate prize winner may be selected, in the sole discretion of Sponsor, time-permitting. If a Potential Prize Winner timely responds with their contact information, the verification process will continue. Entrants are encouraged to check, during the Promotion Period, any archived messages on their accounts on the applicable Entry Platform in the event that any message from the Administrator is diverted to the message “request” section of their account.
B. Winner Notification/Documents.
To the extent permitted by applicable law, Potential Prize Winners will then receive Grand Prize claim documents (Declaration of Eligibility, a Liability Release, travel release and, where lawful, a publicity release and any other documents required by the Sponsor (“Prize Claim Documents”) provided via DocuSign. Potential Prize Winners will also receive appropriate Forms. All Prize Claim Documents must be executed and returned via DocuSign within five business days from the time they are received by the Potential Prize Winner, or the applicable prize may be forfeited. Prize Claim Documents will also include appropriate releases for the guest of the Potential Prize Winner. Potential Prize Winners may be required to furnish proof of identification acceptable to the Sponsor. Such proof may include that Potential Prize Winner provides proof of a valid passport and any visa or other paperwork required to travel to the winning destination. Only necessary passport details will be processed, and any national identification numbers may be redacted where not legally required. The Grand Prizes will be awarded within 4-6 weeks after verification of the Potential Prize Winners’ eligibility and completion of the prize claim process.
C. Prize Conditions. The Sponsor may conduct publicity surrounding the Promotion and Potential Prize Winners. Therefore, Sponsor reserves the right to conduct a confidential background/criminal check (where legal) to confirm a Potential Prize Winner’s eligibility and compliance with these rules and to review Potential Prize Winner’s social media accounts or other public facing communications or actions. By entering, you agree to cooperate reasonably with any such background check. If a background check reveals that a Potential Prize Winner has engaged in any conduct that could damage or negatively affect the reputation or business of Sponsor or the Promotion Entities, as determined by Sponsor in its sole discretion, the Potential Prize Winner may be disqualified, and the Grand Prize may be awarded to an alternate Eligible Participant, following the process set out in the preceding rules. Any information obtained pursuant to this background check will be collected, used and/or disclosed in accordance with the Sponsor Privacy Policy. You agree to provide any further specific consent that Sponsor may reasonably request in this regard. The Promotion Entities shall not be held responsible for any delays in awarding a Grand Prize for any reason outside of their control. Grand Prizes will only be awarded to verified Grand Prize Winners. Any unclaimed prize will not be awarded. The Promotion Entities are not responsible for any change of mailing address, email address, and/or telephone number of Eligible Participants.
By accepting a Grand Prize, each Prize Winner agrees to grant the Sponsor the right to use his/her name, address (city and state/province/territory/county of residence), voice, and statements relating to the Promotion or Sponsor, and photographs or other likenesses, without further compensation, notification or permission in any publicity or advertising carried out by Sponsor or any related entities in any and all media now known, including the internet, without territorial or time limitation, provided however that such use will be made only in the context with this Promotion. For Grand Prize Winners residing in France only: The preceding provision is not applicable.
8. Choice Of Law and Jurisdiction:
For Residents of the United States: All issues and questions concerning the construction, validity, interpretation and enforceability of the Promotion Official Rules, or the rights and obligations of participant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Illinois, U.S.A., without regard to Illinois or any other conflicts of law principles. All Eligible Participants consent to the jurisdiction and venue of the federal, state, and local courts for Cook County, Illinois. Notwithstanding this choice of law, participants shall be entitled to the protection afforded by the mandatory law of the country of their place of residence. To the extent permissible by applicable law, any dispute arising out of or in connection with these Official Rules shall be subject to the exclusive jurisdiction of the courts of the place where the consumer is resident or domiciled, in accordance with applicable consumer protection laws. Applies to Eligible Participants residing in France only: For Eligible Participants residing in France, the preceding provision in this Rule 8 regarding the applicable law does not apply. Instead, the following applies: All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, or the rights and obligations of Eligible Participants and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of France.
9. Privacy: Information collected from Eligible Participants is subject to Sponsor’s Privacy Policy. Sponsor is the data controller for purposes of the Promotion. To review Sponsor’s privacy policy, please visit (https://nianticlabs.com/privacy?hl=en) to see how Sponsor use personal information obtained in connection with this Promotion. Grand Prize Winners’ names may be included in a publicly available winners list. Sponsor agrees to take reasonable measures to help ensure that all personal data collected during the course of the Promotion including, but not limited to, name, mailing address, phone number, and email address will only be used for the purpose of administering the Promotion and the collection of such data complies with (i) all applicable laws, including without limitation, all state, provincial/territorial and federal laws, corporate standards, policies, regulations, as well as the General Data Protection Regulation (“GDPR”) and the laws of individual U.S. states and Canada and French Data Protection Law (collectively “Applicable Laws”) (ii) the principles, guidelines, rules and codes of conduct of self-regulatory organizations such as the Digital Advertising Alliance, the Interactive Advertising Bureau, the Direct Marketing Association, and other self-regulatory organizations to which third parties providing services, platforms, and data are bound, and any required notices and consents; and (iii) privacy disclosures and information collection requirements imposed on advertisers by targeting of media in order to comply with Applicable Laws. Where required by Applicable Laws, Sponsor will deploy appropriate notices and functionality to obtain authorizations and consents as required.
Personal data collected may be used by Sponsor to verify an Eligible Participant’s identity, postal address and telephone number in the event they are deemed a Potential Prize Winner. Personal information collected from Participants will be used by Sponsor solely in connection with the Promotion and will not be disclosed to any third party or used for any other purpose except for the purpose of operating the Promotion, including collecting entries, identifying and notifying winners and fulfilling prize(s) where applicable, and any other use mentioned within this clause. Each declared prize Winner’s first name and first initial of surname, county/region and country will be made available upon request and where required by law. The legal basis for processing the data is performance of a contract and – to the extent that does not apply – the Sponsor’s legitimate interests. The information will be kept for the duration of the contractual relationship between the parties. Your information may also be transferred to countries outside of your jurisdiction of residence, including the United States. Such other countries may not have privacy laws and regulations that provide the same level of protection to those that exist in your jurisdiction. Subject to Applicable Law, Eligible Participants have the right to review, rectify or cancel any personal data held by Sponsor in connection with this Promotion by contacting sweepstakes@nianticlabs.com. Likewise, Participants have the right to file a complaint with the competent authority on data protection in their place of residence.
Applies to Eligible Participants residing in France only: For Eligible Participants residing in France, the following provisions apply in addition to the provisions of Rule 9 above: The Sponsor may share the Eligible Participants’ personal data with Administrator in order to carry out the selection of winners and fulfillment of the Grand Prizes. The Eligible Participants’ have a right to (i) access, correct, update, enrich their personal data, (ii) have their personal data locked or deleted from the data controller’s database, (iii) set the consequences of their death on their personal data and (iv) to oppose the data processing. In addition, Eligible Participants have the right to lodge a complaint with the Commission Nationale de l’Informatique et des Libertés (CNIL : www.cnil.fr).
10. Limitations of Liability:
(i) Eligible Participants agree, to the fullest extent permitted by the laws of their Jurisdiction: to indemnify and hold harmless Promotion Entities from any claims, actions, losses, liabilities, costs and expenses (including but not limited to attorneys’ fees), injury, loss or damages of any kind (collectively, “claims”), resulting from participating in the Promotion or any claims arising from the acceptance, possession, or use or misuse of the prize awarded or participation in any prize-related activity. This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages; loss of data, income, or profit; loss or damage to property; and claims brought by third parties.
(ii) To the extent permissible by applicable law, Eligible Participants agree that Promotion Entities have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, statutory, express or implied (including but not limited to, the implied warranties of merchantability, title, and fitness for a particular purpose), in fact or in law, relative to the Promotion or the Grand Prize awarded.
(iii) Without limiting the generality of the foregoing, to the extent permissible by applicable law, Promotion Entities do not make any express or implied warranties or representations with respect to the Sponsor site, or any promotional website and Promotion Entities shall not be liable for the consequences of any interruptions or errors related thereto. This does not affect your statutory rights, and nothing in these Official Rules shall exclude or limit in any way any entity's liability for personal injury or death caused by its negligence, for fraud or for any other where liability may not as a matter of law be limited.
(iv) Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of such term or any other provision. Sponsor reserves the right to disqualify any Eligible Participant who violates these Official Rules, any other rules, guidance or instructions set out by the Sponsor in promotional material relating to the Promotion or interferes with the Promotion in any manner. If an Eligible Participant is disqualified, Sponsor reserves the right to terminate such Eligible Participant’s eligibility to participate in the Promotion. Any attempt by an individual to access any website associated with the Promotion via a bot script or other brute force attack or any other unauthorized means will result in that individual’s IP address and all entries from that IP address becoming ineligible. Use of automated entry devices or programs is prohibited. Without limiting the generality of the foregoing, to the extent permissible by applicable law, each Eligible Participant agrees to release and hold harmless the Promotion Entities from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property related cause of action that relates in any way to the entry.
(v) To the extent permissible by applicable law, and subject to providing the Eligible Participants with reasonable prior notice, Sponsor reserves the right in its sole discretion to cancel, modify and/or suspend this Promotion at any time if fraud, technical failures, including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes (such as force majeure events) impairs the administration, security, integrity or proper play of the Promotion. In the event of cancellation, Sponsor reserves the right in its sole discretion, to randomly select the Grand Prize Winners from among all eligible, non-suspect entries received up to time of such cancellation. In no event will the Sponsor be liable for more than the stated number of Grand Prizes in these Official Rules.
(vi) The Promotion Entities do not warrant that access to the Promotion will be uninterrupted. To the extent permissible by applicable law, the Promotion Entities are not responsible for any problems that may arise, including but not limited to: (a) lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connection, availability or accessibility problems arising in connection with or over the course of the Promotion; or (b) communications failed, jumbled, scrambled, delayed, or misdirected, or computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; or (c) failure of personal computers or mobile devices and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in connection with the administration of the Promotion, the processing of points or entries, or the offering or announcement of any prize or in any winner notification documents; or (d) for any other errors of any kind relating to or in connection with the Promotion, whether human, mechanical, clerical, electronic, or technical in nature; or (e) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Promotion; or (f) damage to a user's system occasioned by participation in this Promotion or downloading any information necessary to participate in this Promotion. The Promotion Entities are also not responsible for lost, late, delayed, garbled, stolen, incomplete, misdirected, illegible, damaged or undelivered mail, email, or entries. Proof of transmission (screenshots, etc.) does not constitute proof of delivery.
(vii) Applies to Eligible Participants residing in Germany only: For Participants residing in Germany, the preceding provisions in this Rule 10 do not apply. Instead, the following applies: The Sponsor and the Promotion Entities shall be fully liable for intent and gross negligence as well as for damages caused by injury to life, body or health.In an event of property and financial losses caused by slightly negligent behavior, the Sponsor and the Promotion Entities shall be liable only for breaches of a material contractual obligation (cardinal duty), and limited to the typical, foreseeable damages. A “cardinal duty” in the meaning of this provision is an obligation that need to be fulfilled to permit proper execution of these Official Rules and that may regularly be relied upon by the Eligible Participant. The limitation of liability shall apply mutatis mutandis to the benefit of the employees, agents and vicarious agents of the Sponsor and the Promotion Entities.Any potential liability on the part of the Sponsor or the Promotion Entities for any guarantees and for claims based on the German Product Liability Act shall not be affected.
(viii) Applies to Eligible Participants residing in the UK only: For Eligible Participants residing in UK, the preceding provisions in sub-sections (i) (ii) and (iii) of this Rule 10 do not apply. Instead, the following applies: Promotion Entities will not be responsible for (i) any losses that were not caused by any breach of these Official Rules by the Promotion Entities; (ii) any business loss (including loss of profits, revenue, contracts, anticipated savings, data, loss of goodwill, or wasted expenditure), or (iii) any indirect or consequential losses that were not foreseeable to both at the time of participation in this Promotion. Promotion Entities will also not be responsible for any delay or failure to comply with their obligations under these Official Rules if the delay or failure is attributable to circumstances beyond Promotion Entities’ reasonable control. This provision does not affect a Grand Prize Winner’s right to receive the relevant Grand Prize within a reasonable time. Nothing in these Official Rules excludes Promotion Entities’ responsibility to UK Eligible Participants for fraudulent representations made by Promotion Entities’ or for death or personal injury caused by Promotion Entities’ negligence or willful misconduct.
(ix) Applies to Eligible Participants residing in France only: For Eligible Participants residing in France, the following provision applies instead of the provisions regarding the Sponsor’s limitation of liability set forth in Rule 10 above: In accordance with article l221-15 of the French consumer code, the Sponsor may be relieved of all or part of its responsibility if it evidences that the breach or the improper performance of these Official Rules is related either to an entrant, or to the fact, unpredictable and insurmountable, of a third party to the Official Rules, or to a case of force majeure.
(x) Applies to Eligible Participants residing in the Netherlands only: Nothing in this Rule 10 shall exclude or limit the Sponsor’s or the Promotion Entities’ liability for damage resulting from intent (opzet) or gross negligence (grove schuld), or for damage resulting from injury to life, body or health.
Disclosures:
Any attempt by an Eligible Participant or other individual, to deliberately damage any website or undermine the legitimate operation of this Promotion, including but not limited to any fraudulent claims, may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages (including attorneys' fees) from any such individual, to the fullest extent permitted by law, including criminal prosecution. Eligible Participants engaging in any of the foregoing activities may be disqualified (and all associated entries will be void) and will forfeit any Grand Prize won. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
To the extent required by applicable law, and notwithstanding anything elsewhere in these Official Rules, no person’s or entity’s liability for death or personal injury caused by its negligence shall be limited in any way, and nor shall their ability for fraud or for any other matter where liability may not as a matter of law be limited or excluded. Where these Official Rules provide for discretion exercisable by a Promotion Entity (to the extent permissible by applicable law) that could otherwise be capable of causing a significant imbalance in the parties’ rights and obligation hereunder, to the detriment of a consumer and contrary to the requirement of good faith, shall be exercised reasonably and in good faith.
In the event of any conflict with any Promotion details contained in these Official Rules and Promotion details contained in Promotion materials (including but not limited to point of sale, television, and print advertising, promotional packaging, and other promotion media), the details of the Promotion as set forth in these Official Rules shall prevail.
The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In particular, Sponsor's employees are not authorized to waive, modify or amend any provision or provisions of these Official Rules in any manner whatsoever.
Prize Winners: The list of Prize Winners in the Promotion will be made available upon request at sweepstakes@nianticlabs.com (until 30 June 2026) and where required by law.
